so we know them very well.
We take your situation seriously. We know you are going though a hard time and we are here to help. We are not just about getting you to hire us, take your money and move on. We are about getting your life on track. We have a lot more to offer than the standard bankruptcy firm and let us explain why:
1. As we are not a bankruptcy mill you can expect personalized service from us, with an attorney and paralegal team assigned to your own case. If you read the chat rooms you will note that in many firms people never meet the bankruptcy lawyer. In our firm, not only will you spend time with your personal bankruptcy attorney who will return your calls promptly and answer all of your questions, but you will get a lot more than with most firms.
2. We work with credit repair firms. You need to get a fresh start. Some people like a hand and some mentoring. We can help get your credit to where it needs to be so that you can rebuild your life.
3. If you own a company, we have a consulting company that can help with anything from financial restructuring to operations, marketing and advertising guidance &support so that you can get it back on track. Remember the definiton of insanity: doing the same thing over again and expecting a different result. Something has to change.....or expect the same result.
CHAPTER 7 BANKRUPTCY
If you are new to Chapter 7 bankruptcy issues, we will explain it in an overview fashion here, and for those of you who want more detailed information, you can go deeper within our web site. Many people simply want a few straight answers about bankruptcy and then want to speak with a bankruptcy lawyer. Our direct line is 214-295-4150.
Simply speaking, a Chapter 7 bankruptcy wipes out all of your debts. Chapter 13 is the one that restructures your debts so you can pay them back over time. Although it is very respectable that people honor their obligations and want to pay them back, the sad truth is that many people who file a Chapter 13 Bankruptcy later end up converting it to a Chapter 7 Bankruptcy. Why?
The problems that got you to where you are do not simply go away when you file bankrpuptcy or lower your payment. They still remain. In many ways, if you don't attack the underlying problem, it comes back, and bankruptcy is just a termporary band-aid. We take a different approach. We look at the bigger picture.
We look at you as the human being, not the casefile. The first thing we do is propose a credit repair regimen to begin as soon as you file your bankruptcy. Why? If you don't take maximum benefit of what is available to you, the cycle begins again because you will be paying higher interest rates for everything and you will get to a position where you will be paying off purchases for the rest of your life if your interest rate is 30%.
The next step, if you're interested, is to have a consultation with an accountant so that we can examine some areas of difficulty and prevent the cycle from repeating. It's true- had you analyzed your finances on a semi-regular basis, you would have seen this crash coming. We want to prevent it from repeating and get you on your way to success again. We have some books we can recommend, ideas we can offer, and much more. We are not here to simply get your money and run.
On the other hand, if you are one of those clients who knows what they want and just want us to file a Chapter 7 bankruptcy and nothing more, done.
CHAPTER 7 BANKRUPTCY BASIC INFORMATION
-There is no limit on the amount of debt that can be wiped out; there is no dollar limit set.
-With a Chapter 7 BK you can wipe out a variety of debt such as credit card and payday loan debt.
-Some debt cannot be wiped out and you need to be aware of this. For example, child support and alimony cannot be wiped out. Student loans and most taxes are in this category as well, as are government fines. These are situations where you will require higher level help from us so that they do not crush you and bring you down when you get your fresh start.
-Most of the items you own will come under the category of what is known as EXEMPT PROPERTY and you will be allowed to keep it, even if you are wiping out the card you bought the item with and still owe payments on. There are dollar limits as to what you can keep and this is an area where you don't want to fall into the fraud category with. Many people go out and mak multiple purchases, knowing they will file a Chapter 7 bankruptcy. Discuss this with your bankruptcy lawyer as the last thing you need is to have your entire bankruptcy invalidated...and yes, it happens to many people who choose the least expensive bankruptcy firm they can find. Why? If you are paying very little for your BK case, how much time do you think the lawyer or bankruptcy law firm has for each case? We are not the most expensive nor the cheapest, but we try to offer you more than any BK law firm you can find.
-For purposes of a Chapter 7 bankruptcy, you can keep your home if your equity (value minus mortgage remaining = equity) is below a certain value. The catch? You must keep all your mortgage payments current. A Chapter 7 BK will stall foreclosure temporarily but you must sit with one of our lawyers to analyze your picture and determine if you have a chance at keeping it. The good news is that without all of the other payments you have been struggling with, you may have enough money left over monthly to keep your home. There is a lot of planning that has to be done in order to file a case that will really help you; we offer you all the care you need.
-People contemplating bankruptcy also ask us about their cars. As long as your equity is below a certain amount, yes you can keep your car. However, you must keep all of your payments current, just as with your home. Filing a Chapter 7 BK only stalls an auto repossession temporarily, around a month or so. Again, you have to plan this with our bankruptcy lawyers so that you can balance everything out and keep as much as possible without placing yourself in an undue strain.
